sam2011 Posted April 28, 2005 Report Share Posted April 28, 2005 there might be a little colorful language in here, im pissed....sorry :blackeye: so im driving to work this morning, im going down a slight hill thats slightly turning to the left, im going about 40 MPH, in 4th gear...it rained a bit here and there, so the roads are a little slick. its blacktop too. at the last half second, i notice a f**king glass jug (a little bigger than a plastic milk gallon) right in front of me. so i swerve, and being that my RX-8 is real wheel drive, i lose control and start sliding hard to the right...making my right front tire go into a f**king 2 and a half foot deep pothole (mind you im going 40 MPH) on the curb, bending my rim and axle to the point where the actual tire is rubbing against the wheel well. my steering wheel fails, and as much as i turn it, my car is going all over the place. i shift down to 2nd and that helps slightly. thank the lord there was nobody anywhere near me. so i managed to get into a parking lot and surveyed the damage. my wheel well is f**king dented, rim is REALLY dented, and my axle is going to need one hell of an alignment. f**king hell. so...am i able to get any $$ from the municipality i was in because of the pothole? or because i lost control is it my fault? should i call a lawyer? i have a good driving record (with the exception of a few speeding tickets back in college), and comprehensive insurance coverage, so im sure that will be helpful...but im just so f**king pissed, i want to do more...is there more i can do? thanks guys... -sammy Quote Link to comment Share on other sites More sharing options...
chainsaw Posted April 28, 2005 Report Share Posted April 28, 2005 Similar situation happened with my grandma. She has a CLK 430 and the wheels and tires are in the 1k range each. She blew out a tire and rim on a pothole in Dallas and did go thru the city's liability insurance. Call the municipality and see what happens, you'll probably have to talk to 15 diff. people before you get the right one but it would be worth it. I claim each dented rim with the State due to the street conditions, it will take several months but most states will send you a check after they investigate. I received 1000.00 for 2 20"dented rims I received 3400.00 for a pile of rocks being on the road and scratching my paint job. Your Insurance company will cover it if they are any good. irish555 Posted April 28, 2005 Report Share Posted April 28, 2005 Thsoe are all great answers, but where I live, it takes a whole ot more than that do get anything done. First thing I would do is contact your lawyer(if you have one, like me) and find out if he knows the laws regarding that. In KC, I could die after my car fell into a pothole(and they get that big around here) and not get a dime from the city. The only thing they would eventually do, if there are enough complaints, is to fill it in with some loose asphalt, which would be gone in two days anyway. Or worse, put some stupid metal plate over for a year before anyone got out to it, and then they'd just porr some asphalt into it and say it was fixed.
